Terms and Conditions of Sale

Article 1 - Preamble

These General Terms and Conditions of Sale (GTCS) apply to all orders placed on the Vinylbleu.fr website. They define the rights and obligations of the parties in the context of the sale of physical and digital products, sold directly by Vinylbleu or under mandate.

Article 2 - Acceptance of GTCS

Any order implies unreserved acceptance of these GTCS. The customer declares to be of legal age and to have the necessary legal capacity.

Article 3 - Prices

Prices are indicated in euros, all taxes included. Vinylbleu benefits from the VAT exemption scheme in accordance with article 293B of the French General Tax Code (CGI).

Article 4 - Products sold under mandate

For certain products, Vinylbleu acts as an agent (mandatary), in accordance with articles 1984 and following of the French Civil Code.

• Vinylbleu sells in the name and on behalf of the seller indicated on the product page
• The seller remains the legal seller of the product
• The seller is solely responsible for legal rights and guarantees

Article 5 - Delivery of physical products

Physical products are delivered to the address indicated by the customer. Delivery times are provided for indicative purposes only.

Article 6 - Right of withdrawal (physical products)

In accordance with article L221-18 of the French Consumer Code, the customer has a period of 14 days from the receipt of the product to exercise their right of withdrawal.

Article 7 - Digital products - General provisions

Digital content (tracks, EPs, albums) does not constitute a sale of goods but the granting of a personal user license.

• Non-transferable license
• Strictly personal use

Article 8 - Digital products: waiver of the right of withdrawal

In accordance with article L221-28-13° of the French Consumer Code and EU Directive 2011/83/EU, for digital products (audio downloads, digital files), the customer expressly consents to immediate execution of the contract upon payment validation and acknowledges that they lose their right of withdrawal as soon as the file is effectively downloaded.

Consequently, no refund may be claimed once the download has been completed. This information is reminded to the customer at the time of ordering in the payment funnel.

Article 9 - Digital products sold directly by Vinylbleu

For certain digital content, Vinylbleu acts as the direct seller and grants the user license to the customer.

Article 10 - Digital products sold under mandate

For certain digital content, Vinylbleu acts as an agent. The label or producer indicated remains the exclusive holder of the rights.

Article 11 - Liability

The legal seller (Vinylbleu or the principal) is solely responsible for the conformity and rights related to the works.

Article 12 - Payment

Payments are secured via Payplug or by bank transfer.

Article 13 - Personal data

Data is processed in accordance with the GDPR. The customer has a right of access, rectification, and deletion.

Article 14 - Applicable law

These GTCS are subject to French law. Any dispute falls under the jurisdiction of the French courts.
